Term and Termination

This User Agreement runs for an indefinite term.

Either Party may terminate this Agreement at any time by giving 14-days notice (written or electronic communication, e.g. via e-mail, required). You may also terminate the User Agreement with immediate effect by deleting the App from your device or removing the App from your Facebook apps.

If we have reasonable ground to believe that you are in material breach of these Terms of Service, we may suspend your access to our App and/or terminate this User Agreement. Your breach of Sec. 2 or 3.4. shall be considered a material breach.

Either Party may terminate the User Agreement for cause without giving notice. The grounds for such termination for cause include material breach of these Terms of Service.

However, any app-related data cannot be restored.

We may (a) suspend your rights to use any App, and/or any related services or (b) terminate this Agreement at any time for any reason at our sole discretion with or without notice to you, including if we in good faith believe you have violated the Acceptable Use Policy or any other provision of this Agreement. AI Features

By uploading any photos, videos, or other content to the App and using AI features, you explicitly consent to the processing of such content by artificial intelligence systems hosted on third-party cloud infrastructure for the purpose of generating the requested outputs.

You acknowledge and agree that your uploaded content may be transmitted to and processed by third-party service providers, including but not limited to fal.ai, eachlabs, OpenAI, and Google Gemini, solely for the purpose of providing AI usage.

Processing of User Content may occur on remote servers operated by our third-party service providers. No AI processing occurs locally on your device.

Your User Content is not used to train or improve third-party artificial intelligence models, unless explicitly disclosed and consented to.

AI-generated outputs may be inaccurate and/or incomplete. You acknowledge that you use such outputs at your own risk and should independently verify their accuracy where necessary. You acknowledge that AI-generated outputs may not be unique and that similar or identical outputs may be generated for other users. You agree not to misrepresent AI-generated content as human-generated where such representation would be misleading, deceptive, or unlawful. Your use of AI-powered features may also be subject to the terms, conditions, and privacy policies of our third-party service providers.

Our apps do not collect or store biometric identifiers or facial recognition data. Our app processes images uploaded by users, which may include faces. We do not collect, store, or use biometric identifiers or facial recognition data (such as facial geometry or identity data), and the app does not identify or authenticate individuals.

Face data is used only to generate videos or visual content based on user-provided images and is not used for tracking, profiling, or identification purposes.

We do not share face data with third parties for marketing or advertising purposes. User-uploaded images may be temporarily processed by trusted service providers solely to operate the app. These providers process data on our behalf, do not retain it, and delete it after processing.

All data is retained only as long as necessary and is deleted within 30 days, unless a deletion request is made earlier. Users can request deletion at any time by contacting support@scateapps.com.

You use all Third-Party Services at your own risk. When you access a Third-Party Service, the applicable third party’s terms and policies apply, including the third party’s privacy policies. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction in connection with any Third-Party Service.

Other Users

An App may contain User Content provided by other users of the App. Scate Apps is not responsible for and does not control the User Content. Scate Apps has no obligation to review or monitor, and does not approve, endorse, or make any representations or warranties with respect to User Content. You use all User Content and interact with other users at your own risk. Your interactions with other users are solely between you and the other user and we are under no obligation to become involved. You agree that Scate Apps will not be responsible for any liability incurred as the result of any such interactions.

Release

You hereby irrevocably and unconditionally release and forever discharge Scate Apps (and its suppliers) from any and all claims, demands, and rights of action, whether now known or unknown, which relates to any interactions with, or act or omission of, any Third Party Service, other Apps users, or Third-Party Advertisers. Fees

In-app purchases

Scate Apps may license to you certain virtual goods to be used within the Service and which you may purchase with real cash or which you may earn or redeem via app use (“Virtual Items”). Virtual Items are licensed to you on the limited, personal, non-transferable, non-sublicensable and revocable basis and limited only for non-commercial use. Scate Apps may manage, control, modify or eliminate Virtual Items at any time, with or without notice. The transfer of Virtual Items is prohibited, except where expressly authorized in the Services, if any. Virtual Items do not have an equivalent value in real cash and do not act as a substitute for real world money. Neither Scate Apps nor any other person or entity has any obligation to exchange Virtual Items for anything of value. Scate Apps has no liability for hacking or loss of your Virtual Items. Price and availability of Virtual Items are subject to change without notice. Subject to mandatory legislation, all purchases and redemptions of Virtual Items made through the Services are final and non-refundable. You acknowledge and consent that the provision of Virtual Items for use in Services is a process that commences immediately upon purchase and you forfeit your right of withdrawal once the performance has started. Subject to mandatory legislation, you agree that Scate Apps is not required to provide a refund for Virtual Items for any reason and that you will not receive money or other compensation for unused Virtual Items, whether your loss of license under this Agreement was voluntary or involuntary. If you request that your personal data to be erased as specified in Scate Apps Privacy Policy, you will permanently and without a right to a refund lose all your Virtual Items as Scate Apps can no longer associate such Virtual Items with you. YOU ACKNOWLEDGE THAT Scate Apps IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN YOU DELETE YOUR ACCOUNT OR WHEN YOU CEASE TO USE THE APP.

You cannot cancel Your current Subscription if it has already been activated. Except when required by law, paid Subscription fees are non-refundable. Scate Apps in its sole discretion and at any time may modify the Subscription Fee. Any Subscription fee change will become effective at the end of the current subscription period. You will be provided reasonable prior notice of any change in Subscription Fee. If you do not take action to agree to the increase in Subscription Fee, Your Subscription shall expire at the end of the current subscription period.
